01 Acceptance of Terms
Welcome to The Backlog (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website at thebacklog.games and The Backlog iOS mobile application (collectively, the “Services”). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
02 The Service
The Backlog is a video game collection tool that helps users track, organize, and manage their personal video game libraries. The app allows you to record games you own, maintain a wishlist, track play status, and add personal ratings. Your collection data is stored locally on your device.
03 Eligibility
The Backlog is available to users of all ages. The Services do not require account creation, and no personal information is required to use them. If you are a minor, you should review these Terms with a parent or guardian.
04 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from any part of the Services except as expressly permitted by law.
05 Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Interfere with, disrupt, or compromise the security or integrity of the Services
- Attempt to gain unauthorized access to any systems or networks
- Use automated means to access, scrape, or extract data from the Services in a manner that disrupts their normal operation
06 Your Content and Data
Any video game collection data you enter into The Backlog is stored locally on your device and remains yours. We do not access, transmit, or store your personal collection data on our servers. You are responsible for maintaining and backing up your own data. We recommend using your device’s built-in backup tools (such as iCloud). If you delete the app, your locally stored data will be removed from your device, and we cannot recover it.
07 Intellectual Property
All content, design, branding, logos, and software associated with The Backlog are owned by us or our licensors and are protected by applicable intellectual property laws. Game titles, artwork, and related materials referenced within the Services may be the property of their respective owners and are used for identification and organizational purposes only.
08 Third-Party Links and Services
The Services may contain links to third-party websites or services, such as game databases, storefronts, or review platforms, that are not operated by us. We are not responsible for the content, products, or practices of any third-party services. Your use of those services is at your own risk and subject to their own terms.
09 Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any game data provided will be complete or accurate.
10 Limitation of Liability
To the fullest extent permitted by law, The Backlog and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of or inability to use the Services. Because your collection data is stored only on your device, we are not responsible for any loss of that data.
11 Changes to the Services and Terms
We may modify, suspend, or discontinue any part of the Services at any time without notice. We may also update these Terms from time to time. When we make material changes, we will update the “Effective Date” above and post the revised version on our website and/or within the app. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
12 Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or for any other reason. You may stop using the Services at any time by discontinuing use and deleting the app.
13 Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law principles.
